Data protection information in accordance with Art 13 GDPR

The mdw – University of Music and Performing Arts Vienna (mdw), Anton-von-Webern-Platz 1, 1030 Vienna, Austria, places great importance on the protection of data pertaining to your person. For this reason, in accordance with the relevant data protection regulations, we would like to inform you about the collection, processing and use of your data in connection with your registration for the Symposium “Music Therapy with Families”, 23rd-25th September 2022.

Before providing us with your data, please carefully read the following information and rules.

Use of Zoom

For the performance of a meeting and giving access to it, mdw relies on cloud-based language and video services, in the instant case Zoom. Legal basis for the data processing is the implementation of the university‘s leading principles and tasks being of public interest, Art. 6 para. 1 e GDPR in conjunction with Sec. 2 Nos. 8, 13, 14 and Sec. 3 Nos. 6 to 8, 11 University Act. As far as the Covid-19 pandemic is concerned, legal basis is the fulfilment of legal obligations (Art. 6 para. 1 c and e GDPR in conjunction with the relevant regulations of the Federal Ministries as well as the protection of essential interests of the data subject or other natural persons (Art. 6 para. 1 d GDPR)), while maintaining the university life and administration. Additionally, it is required for the fulfilment of duties of care of mdw as an employer according to Art. 6 para. 1 b GDPR.

Registration for your participation via Zoom

In case you register for a meeting at mdw via Zoom, your personal data will be processed for the registration process and the respective meeting. The processing is carried out in order to take steps prior to entering into a contract or, after confirmation of the successful registration, because of such contract according to Art. 6 para. 1 b GDPR or, respectively, because of tasks carried out in the public interest according to Art. 6 para. 1 e GDPR in conjunction with Secs. 1 to 3 University Act.

Purpose and legal basis of the recording

If you are participating via Zoom, your registration name and, in case of use of the camera function, also your image will be visible. If you are participating by performing or commenting in the discussion and have enabled the audio and video functions, you will be heard and seen by the participants. For documentation and information purposes of mdw, also the zoom activities will be recorded and thus recordings of your participation will be possible. 

If you do not want to be part of the recording, do not enable camera or microphone functions while using Zoom. Those are deactivated by mdw in its function as the host by default. An active participation in the discussion is only possible after activation of those functions though.

If you are participating in−person your image might be visible online. If you are performing or commenting in the discussion, you will be heard and seen by the online-participants.

For documentation and information purposes of mdw, live lectures and discussions will be recorded on site and thus audio and video recordings of you will be possible.  

The legal bases are the fulfilments of contractual obligations according to Art. 6 para. 1 b GDPR (granting of rights), the public interest according to Art. 6 para. 1 e GDPR in conjunction with Secs. 1, 2, 3 No. 11 University Act or, as far as mdw is not acting in its capacity of an official authority, the legitimate interests of the controller according to Art. 6 para. 1 f GDPR. In the latter case, the data is only processed if legitimate interests of mdw override those of the data subject in a proportionate manner (Art. 6 para. 1 f GDPR in conjunction with Sec. 12 para. 2 No. 4 Data Protection Law). The data is exclusively processed for the mentioned purposes via usage of modern media of the audio and video materials (Facebook, YouTube, Streaming, etc.). The data is used only to the extent necessary and in a transparent way. Appropriate technical and organisational measures are naturally applied.

Saving, processing, and erasure of data

The audio and video materials relating to your person will be saved for the duration of the contract and furthermore as long as necessary for performance of the processing purposes. The duration of the saving is determined in particular by the following aspects: type of meeting during which the recording was made; type of reproduction (number of persons, reproduced environment, situation); eligibility for documenting the history of mdw; eligibility for use in anniversaries and festschrifts as well as for archiving; eligibility for usages on websites and in print, YouTube and in social media (e.g., Facebook); actual relevance and relevance for the effective addressing of the general public; grade of infringement of the right to privacy of the data subjects; other interests of the data subjects. Additionally, your data will be stored for the prescription period of potential legal claims. The registration data will be erased after one year at the latest.

Recipients

The processing of your personal data is undertaken at first by employees of mdw. The video and audio materials relating to your person will be used for contractual, teaching, documentation and information purposes and thus be published and made accessible for everyone.

During the use of Zoom, your data may (refer to the Privacy Data sheet of the provider) be submitted to a recipient in the United States of America. Your Rights

As a data subject affected by this data processing you are entitled to the following rights: right of access (Art 15 GDPR), right to rectification (Art 16 GDPR), right to erasure (Art 17 GDPR), right to restriction of processing (Art 18 GDPR), right to data portability (Art 20 GDPR), right to object (Art 21 GDPR).
